On the afternoon of August 23, 2023, the Albuquerque Police Department responded to a disturbance call at the address of 3806 Montgomery Blvd NE. Dispatched to the scene, officers were met with an account of an unidentified male engaged in aggressive behavior at Blake’s Lota Burger and shattered glass at the restaurant.
According to information provided by dispatch, the incident involved the male subject venturing to the restaurant and launching rocks through its windows. The situation escalated further as he allegedly assaulted another male on the premises. As officers arrived at the scene, the observed three windows and a glass-paneled door were shattered.
The criminal complaint, APD interviewed the restaurant manager who identified the suspect as Jerrin Smith, 34, of Albuquerque, and she stated Smith threw rocks through the window. Officers were able to detain Smith nearby at a bus stop.
The complaint goes on to say, a victim on scene said Smith approached in an aggressive manner, delivering a menacing warning concerning his daughter’s well-being. This interaction swiftly escalated into a physical confrontation as Smith allegedly swung at him with a closed fist.
The estimated cost of the damage amounted to $2,680. Smith was booked for criminal damage to property over $1,000 and misdemeanor assault.
