Man and his Passenger Toss Beers Out Window in Front of Deputies During DWI Stop

Early this morning, a Bernalillo County Deputy observed a Toyota sedan driving at a high rate of speed and swerving in and out of traffic. The deputy initiated a traffic stop and as he was approaching the vehicle the driver, 26-year-old Francisco Olivas and his passengers were observed tossing beer bottles out of the vehicle onto the ground.

According to a criminal complaint, the deputy could hear glass bottles hitting the concrete. “I gave the individuals in the vehicle commands to stop throwing things” to which they complied. The deputy then attempted to speak to Olivas but all he would reply is that he did not speak English.

The complaint goes on to say a Spanish speaking deputy came on scene and continued the investigation. He admitted to the deputies he drank four Modelo’s at a party. Olivas provided two breath samples into a certified intoxilyzer and blew a .16/.16 which is two times above the legal limit.

Olivas was booked into MDC without any further incident.
