Albuquerque Police Department homicide detectives charged a Blake’s Lotaburger employee in connection with Thursday’s fatal shooting of a man in the restaurant’s parking lot on Rio Grande Blvd. near I-40.

Christian Elycio, 21, was arrested late this afternoon for the murder of Edward Nicholas, 46, following a dispute between the two men.

According to investigators, witnesses said the two men separated after the initial dispute. Elycio’s uncle, a manager at the restaurant, later went outside to tell Nicholas to leave the property. The uncle told police that Nicholas began reaching into a backpack, prompting Elycio to come out from the restaurant and open fire on Nicholas.

Surveillance video showed Nicholas start to walk away when Elycio approached, but Elycio fired several gunshots at him. Police say that after Nicholas fell to the ground, Elycio ran up to him and fired additional rounds.

Today, the medical examiner revealed that Nicholas had been shot 10 times.

Authorities charged Elycio with an open count of murder and booked him into the Metro Detention Center shortly after 8:00 PM.
