Albuquerque, NM – The Bernalillo County District Attorney’s Office is committed to the pursuit of justice. The week of January 15, 2024, there are five jury trials taking place in Bernalillo County.
David Padilla, 45
Case Number: D-202-CR-202200526
· First Degree Murder (Willful & Deliberate) (Firearm Enhancement)
· Tampering with Evidence
· Receipt, Transportation of a Firearm or Destructive Device by Certain Persons (Felon)
On March 6, 2022, APD Homicide detectives arrested David Padilla and charged him for the overnight shooting death of Devlin Rubi in Northeast Albuquerque. Witnesses told APD detectives that Padilla, 43, and Rubi, 23, were involved in a confrontation Saturday night, March 5th, 2022. The confrontation spilled out to the driveway where multiple gunshots were heard.
Padilla admitted to detectives that he shot Rubi multiple times as Rubi attempted to back a vehicle out of the driveway at 8009 Krim Dr. N.E. Padilla was also shot in the leg during the exchange of gunfire.
Detectives located Ring doorbell camera footage of the shooting which shows a portion of the shooting and the shooter stating, “How do you like that fucker!” just after shots are fired. Witnesses of the shooting stating a male, later identified as Padilla, walked away from Devlin’s vehicle with a significant limp after the shooting.
Padilla was transported from UNMH to the Main Police Station where he was interviewed by detectives. Padilla provided a statement that indicated he was shot by Rubi. Padilla said Rubi dropped his handgun, and Padilla picked it up and shot Rubi several times.
Padilla was booked into the Metropolitan Detention Center and charged with an open count of Murder and possession of a firearm by a convicted felon.
At the time of the 2022 murder, Padilla was on probation for a 2016 incident in which he had pleaded guilty in 2017 to Armed Robbery, Aggravated Battery (Deadly Weapon), and Possession of a Firearm or Destructive Device by a Felon. The charges of Aggravated Assault (Deadly Weapon), Burglary of a Vehicle, Unlawful Taking of a Motor Vehicle (2nd Offense), Receiving Stolen Property – Retain (Firearm), and Possession of a Firearm or Destructive Device by a Felon charge were “Dismissed By Prosecution – Disposition Vacated.”
Caley Volante, 35
Case Number: D-202-CR-201803837
· Aggravated Stalking
On October 26, 2023, a jury convicted Caley Volante of stalking. In 2018, he sent the victim hundreds of Instagram messages and letters and even went to her home, where a relative protected the victim.

· Aggravated Battery (Deadly Weapon)
· 2 Counts of Aggravated Assault (Deadly Weapon)
