DA Brings Up Past Sex and Traffic Charges against Vigilante Flock Camera Guy’s Pre-Trial Hearing, Metro Judge Releases Him But Sandoval County Courts Keeps Him Jailed

The man that live streamed himself taking down Bernalillo County Flock Cameras was in virtual court Friday for his first metro court appearance. 44-year-old Jevon Martinez drove the ire Judge Claire McDaniel during the virtual hearing when Martinez kept walking up to the video camera and waving and doing non-American Sign Language signals to people watching.

“Mr. Martinez you need to have a seat!” said a stern Judge McDaniel.

Many of Martinez’s fans, family, and friends believe the media and the government are just picking on him and are bringing up issues that are “fake” and or fabricated to “keep the man down“. Our news outlet has been inundated with numerous bot accounts saying we are slanderous and going to hell for picking on an American hero.

Martinez’s case was called to the docket by the judge and a public defender stood beside him. Martinez however demanded to represent himself.

“I am here in regards to this matter. Under special appearance and general appearance. And I will be invoking UCC 103 and UCC 1-308,” said Martinez.

The above codes Martinez cited are used by so called sovereign citizens to argue in courts and with everyday contacts when stopped by law enforcement. Judge McDaniel asked he had any argument during his hearing but he stood silent. It was revealed in court by the district attorney’s office that Martinez had an unpaid traffic ticket and he would have to pay that before he could be released from jail.

During the hearing the District Attorney background investigator highlighted all the past sex related and domestic violence cases Martinez has faced over the years. The investigator listed these cases:

• In 2003, Martinez was charged in North Carolina with first-degree sexual exploitation of a minor, third-degree sexual exploitation of a minor and aiding and abetting second-degree sexual exploitation of a minor. The case resulted in a conviction on a reduced charge and a sentence that included confinement and supervised probation.

• In January 2022, Martinez was charged in New Mexico with aggravated driving while under the influence, speeding and related traffic offenses. That case is closed.

• In December 2024, Martinez was charged with two counts of second-degree criminal sexual penetration of a minor between the ages of 13 and 18 involving force or coercion, four counts of second-degree criminal sexual contact of a minor between the ages of 13 and 18 by a person in a position of authority, and two counts of contributing to the delinquency of a minor.

• In January 2025, Martinez was charged with two counts of aggravated assault with a deadly weapon, two counts of battery and criminal damage to property.

• In March 2025, Martinez was again charged with two counts of aggravated assault with a deadly weapon, two counts of battery and criminal damage to property.

“I have no argument. I just, as Mr. Lewis heard me as far as regards to getting that traffic ticket paid today, and I can be released,” said Martinez

Assistant District Attorney of Bernalillo County did not file a pre-trial detention motion and Judge McDaniel did not see a need to hold Martinez. We reached out to the Bernalillo County District Attorney Office’s Public Information Office on why there was NOT a pre-trial motion.

“These violations were non-violent property crimes and he’s being held in another county for violating his terms of release,” said Nancy Laflin, Communications Director for the DA’s office.

Judge McDaniel gave Martinez a strict list of things he is not allowed to do while his case is pending. He responded.

“We got a team of awesome people. Ma’am, you’re going to be here for our show, I promise,” said Martinez.

Martinez has indicated he is representing himself and is not using a traditional lawyer nor the public defender’s office. He or someone connected to him has put up a GoFundMe account and at last check he had a $26,000 goal limit however as the flock story went viral across the nation the fundraiser has now adjusted to $60,000 in goals. The fundraiser says: Thank you from the bottom of my heart for helping me support my family during this time.

Due to his previous Flock Camera take down arrest in Sandoval County he did violate the terms of his release. So, he was technically free on paper from Bernalillo County courts. But, Sandoval County took him into custody for his violations of conditions of release. He was supposed to appear in court back in late September in Sandoval County but a Grand Jury convened to indict him on the Sandoval County flock camera charges.

It is unclear when Martinez will be released from Sandoval County since he violated his conditions of release. We will continue to follow this case and report back to you.
