ALBUQUERQUE – APD homicide detectives charged Ervin Gutierrez today for the overnight deadly shooting of another man during a fight in Northeast Albuquerque.
The men were drinking alcohol while making dinner at an apartment with a relative and got into a fight over the heat of the green chile on the enchiladas they were eating. After the fight, Gutierrez, 22, pulled out a handgun and shot the victim, Nathaniel Cavazos, 25, several times. Cavazos died at the scene.
According to the criminal complaint, Gutierrez kept calling the victim a “bitch” and challenged him to eat more green chile enchiladas. Shortly after a fight broke outside the apartment and gunshots rang out.
Officers responded around 11:30 p.m. to reports of the shooting at the Copper Hills apartments, located at 4200 Spanish Bit St., N.E. While detectives investigated the shooting today, Gutierrez turned himself in to police in Downtown Albuquerque.
Gutierrez is now charged with an open count of murder. He will be booked into the Metro Detention Center.
