Homeowner Shoots Repeat Felon to Protect Grandchild After Felon Runs from APD Detectives

APD detectives apprehended Joseph Rivera, 32, after a pursuit in a stolen vehicle culminated in a crash. Rivera then fled on foot into a nearby neighborhood, where he forcibly entered a residence and was subsequently shot by the homeowner.

On Thursday, March 21, 2024, ABQ RAW was the only media outlet to report on the shooting near Candelaria and Rio Grande. Here’s what unfolded: APD’s Auto Theft Unit, K9 Team, and Intel located a stolen vehicle in the Valley Area Command with occupants inside and initiated surveillance. Detectives deployed stop sticks in an attempt to halt the vehicle. Despite deflating the tires, the suspect persisted in driving on the rims until crashing near Candelaria Road and Rio Grande Boulevard. Rivera exited the vehicle and fled on foot, prompting detectives to establish a perimeter.

Within five minutes, APD’s Emergency Communications Center received a 911 call with an open line, reporting a male intruder in a residence. Dispatch subsequently relayed a description matching Rivera’s. Rivera demanded keys from the homeowner to steal her vehicle. The homeowner directed Rivera to a bowl of keys, from which he seized a set before leaving. She then locked the door behind him, retreated to a bedroom with her young grandchild, and armed herself. Upon hearing Rivera re-entering and demanding more keys, she confronted him in the hallway, ordering him to leave. When he refused, she fired a single shot, wounding Rivera. The homeowner then tended to Rivera’s gunshot wound by applying pressure until officers arrived, with K9 units assisting in his apprehension.

Rivera was transported to UNMH for treatment. Upon discharge, he will be arrested and charged with:

  • Burglary
  • Attempted Felony
  • Receiving/Transferring a Stolen Motor Vehicle

Additionally, Rivera had an outstanding felony warrant related to auto theft charges. According to NM Courts records, Rivera has accumulated numerous felony arrests or charges, including at least three felony drug charges and eight felony charges related to stolen motor vehicles. It is unknown how many times the charges were actually prosecuted, dismissed, or if plea deals were given.
