Byers is currently under the watch of BCSO deputies at UNMH, where he has been recovering from a separate shooting incident that occurred on January 28th. That incident is still under investigation, and it is undetermined if it is related to the homicide of Nunn. A warrant has been approved to charge Byers with an open count of murder, armed robbery, conspiracy to commit armed robbery, and tampering with evidence. He will be formally charged and booked into MDC upon his recovery.

A second suspect identified in the homicide, Elias Acuna, died on January 25th following a possible accidental shooting; the case is still under investigation by the Albuquerque Police Department. The investigation into the homicide of Thomas Nunn continues as there is still a third subject who may have been involved and is not in custody at this time.

The Bernalillo County Sheriff’s Office Violent Crime and Homicide Detectives have worked alongside Albuquerque Police Department Investigators in the case as our agencies have several possibly connected cases.
