Man is Booked who terrorized and shot victims at Rudy’s BBQ Parking Lot

On 6/16/2023, two people were shot and wounded in a parking lot near Rudy’s BBQ and Blake’s Lotaburger near 2321 Carlisle Blvd. NE. When Albuquerque Police Department and New Mexico Police officers arrived they found a chaotic scene with gunshots being fired.

According to the criminal complaint, New Mexico State Police officers responded to the scene quickly because they were at the NMSP District 5 office. When they heard on the radio about an active shooter they immediately went next door to find a security guard who advised them that there was a male with a firearm. A NMSP officer heard two to three gunshots coming from the south of them and he proceeded to run South through the Rudy’s parking lot. He took cover between vehicles parked in front of Rudy’s and had a visual on the male suspect later identified as Emilo Mirabal (aka Emilio Mirabal).

The complaint goes on to state that the officer observed a muzzle flash and the Mirabal kept shooting but then Mirabal took cover behind a brick wall and surrendered to police.

Police were able to find two victims in a truck between Rudy’s and the Motel 6 parking lot.

The pickup was located with the passenger side door open which contained multiple bullet holes. Officers also advised they observed a sawed-off shotgun in plain view inside the vehicle.

Police interviewed the gunshot victims and they stated stated that they do landscaping work and were heading home after a long day of work when they decided to stop at the Blakes Lota Burger and Rudy’s restaurant to get a beverage and some food. As they were attempting to park their vehicle in an empty parking space they noticed multiple shots enter their vehicle through the passenger door window striking a female victim in the face and right side of her body. The male victim was shot in the back and told investigators the shooter said nothing before shooting them.

Mirabal was interviewed by investigators at the hospital and he said he did not remember the incident and was told by police that he was going to be charged with aggravated battery with a deadly weapon to which he said, “that’s not that bad”. He subsequently asked if he had

shot a male and female or a kid.

A NMSP officer and APD officer did fire their weapons at Mirabal and so it resulted in a multi-agency task force investigation.
