On the evening of September 19, 2023, at approximately 9PM, a routine patrol took a surprising turn when a traffic stop led to the arrest of a driver for suspicion of driving under the influence
According to the criminal complaint, as the vehicle approached the intersection of Yucca and Sequoia, it began to drift dangerously close to the right side of the road, nearly striking the raised curb. The driver then made an abrupt left turn onto Yucca Rd without using a turn signal, prompting a Bernalillo County deputy to pull over, Kyle Greer, 32-year-old, of Albuquerque.
Upon making contact with the driver, Greer became increasingly belligerent, claiming he was pulled over for displaying an American flag on his truck. The complaint goes on to say the deputy suspected Greer being intoxicated and observed a strong odor of alcohol on Greer’s breath, bloodshot and watery eyes, and slurred speech. Backup was requested, and Greer was asked to exit the vehicle. He continued to be uncooperative and refused standardized field sobriety tests.
Greer was subsequently arrested and transported to the Mobile BAT Command. Despite being read the New Mexico Implied Consent Advisory, he refused to provide a breath sample. The Intoxilyzer 8000 was initiated but timed out due to Greer’s non-cooperation.
Greer was charged with aggravated DWI Driving While Under the Influence of Liquor and/or Drugs and turning movements and required signals. The complaint did not indicate how big the American flag was and where it was on the vehicle.
