An Albuquerque man has been charged with threatening an FBI special agent after allegedly making death threats during a phone call about firearms seized in an earlier federal investigation.

According to court documents, Alejandro Moya, 36, called the FBI’s Albuquerque Field Office on July 14, 2026, seeking the return of firearms that had been seized during the execution of a federal search warrant in 2020. Prosecutors say Moya told personnel he was “tired of playing games” and wanted the firearms returned.

An FBI special agent later called Moya to discuss the request. During that conversation, prosecutors allege Moya threatened the agent, saying, “Give me my fucking shit or I’m gonna kill you,” and, “I will fucking cut your head off.” Court documents also allege Moya told the agent, “You’re fucking dead,” and challenged the agent to meet him at an Albuquerque residence for a confrontation.

Authorities allege Moya knew he was speaking with an FBI special agent when he made the threats.

Moya is charged with transmitting threatening communications. Following his initial court appearance, he was released on his own recognizance. He is scheduled to appear in federal court on July 20, 2026, for a combined preliminary and detention hearing.

If convicted, Moya faces a maximum penalty of five years in federal prison.

In 2015, Moya was charged with two counts of aggravated assault with a deadly weapon, shooting at or from a motor vehicle without causing great bodily harm, aggravated fleeing from a law enforcement officer and reckless driving. He later pleaded guilty to two felony charges: shooting at or from a motor vehicle without causing great bodily harm and aggravated fleeing from a law enforcement officer.

Court records show Moya was arrested multiple times and faced various charges beginning in 2010. Many of those cases were later dismissed for reasons including insufficient evidence, lack of probable cause, missed filing deadlines, the need for further investigation by prosecutors or some of the charges being dismissed as part of plea agreements.

The FBI’s Albuquerque Field Office investigated the case, and Assistant U.S. Attorney Amy Mondragon is prosecuting it.
