Update on Fatal Crash: Two Innocent Victims Dead, Repeat Felon Charged in Case

As reported yesterday, the Albuquerque Police Department (APD) is investigating a fatal traffic collision that occurred yesterday, July 17, 2024, at the intersection of Marquette Ave. and Espanola St. N.E.

Incident Details:

At approximately 4:20 PM, APD officers initiated a traffic stop on a vehicle in the vicinity of 7817 Central Ave. N.E. The vehicle failed to yield and fled the scene. APD deployed a Star Chase tracking device to monitor the vehicle’s movement.

A short distance later, approximately one mile from the initial stop, the fleeing white Infinity SUV collided with another vehicle at the aforementioned intersection. Two occupants of the second vehicle, a red Chevrolet SUV, sustained critical injuries. One occupant died from their injuries at the scene, while the other occupant died on July 18th at a local hospital.

Investigation:

The APD Motors Unit is conducting a comprehensive investigation into the crash. Concurrently, a separate investigation led by the Multi-Agency Task Force is examining the actions of officers involved in the initial traffic stop.

Suspect:

Police have identified Malaktazadak Kyser, 38, as the driver of the stolen and fleeing Infiniti SUV. He sustained injuries in the crash and was receiving treatment at a local hospital. Authorities booked Kyser into MDC around 2:30 AM on July 18th. The District Attorney’s office is collaborating with APD investigators to determine potential charges against Kyser. On MDC’s website, charges listed include “Homicide by vehicle (resisting, evading or obstructing)” and “Failure to yield (stop or yield sign).”

He has a violent charges dating back to 2021 for embezzlement of a motor vehicle, drug charges, resisting evading police (2 times), and aggravated battery with a deadly weapon (2 times).

His cases were either diverted to probation or nolle prosequi.

Victims:

APD has not released the identities of the deceased women, likely as they notify the next of kin.
