The criminal complaint says that Berry was the back passenger seat of his parents truck when a Toyota Prius tried beside them to zipper merge, which in New Mexico is hotly debated traffic maneuver. The internet often engages on whether it is the right way to merge into traffic. The victim in this incident says that Berry rolled down his passenger side window and pointed a gun at him. He told the victim: “right now. It’s our turn.”

Officers were able to locate the truck within the Sam’s Club parking lot and observed Berry was still inside the vehicle. They conducted a felony stop on the truck and took Berry into custody without incident. He spoke to officers and said he warned the victim by stating: “wanted to get shot.”

During the arrest, the elder Berry’s came out with bulk items and some discounted goods while their son was seated in the back of a police car facing a felony charge of aggravated assault with a deadly weapon. The father said he saw his son roll down the window but did NOT see a firearm pointed at anyone. The mom also said she did NOT see the gun.

Berry was charged with aggravated assault with a deadly weapon in this case.
