Thursday, April 17, 13-year-old Johnathan Overbay was sentenced to the maximum penalty allowed under New Mexico law for the deliberate car crash that killed bicyclist Scott Habermehl. Overbay pleaded guilty to second-degree murder and will remain in custody until he turns 21. He was 12 years old when he drove the vehicle that intentionally struck and killed Habermehl.

Investigators state that on May 29, 2024, at 4:40 AM, officers from the Albuquerque Police Department responded to a fatal pedestrian crash at Moon and Aspen in NE Albuquerque. In February, officers recovered social media posts showing three juveniles— 13-year-old Johnathan Overbay, 11-year-old Messiah Hayes, and 16-year-old William Garcia (Garcia was 15 at the time of the incident)—in what police identified as a stolen vehicle.

Police believe the 11-year-old was holding a firearm in the passenger seat, while Overbay was driving and Garcia recorded the incident. Investigators believe the group deliberately struck Scott Habermehl as he rode his bicycle to work at Sandia Labs.

This case cased outrage in the community and called on lawmakers to tackle juvenile crime laws. Certain lawmakers avoided tackling the problem.

Hayes and Garcia have yet to be sentences for their roles.

  1. Big deal, so they stay in juvenile detention until the repeat offender heathens turn 21 & get out to commit more serious crimes then. I’m sure that’s a huge relief to the scientists family. Hopefully they get life in prison or die in a shootout with police at that time. These 3 are unredeedable.

  2. I had thought the Bernalillo County DA stated that they were seeking FD Murder for all of these POS Lowlife trash??!! Oh well, not surprised.

    Stolen car, possession of firearms, and no regard for human life or respect for anyone while the victim was on his way to work at 4:00 am riding his bike not bothering anyone.

    Do you think its fair???!!!! Do you think this is justice???!!! Do you think the parents (or most likely grandparents since they were most likely MIA and prefer the high life/ party life instead of being responsible parents) will face any consequences – or even give a shit or are even remotely embarrassed for the way they were bringing up (or lack of) their mijo ?! Doesn’t matter! This is Albuquerque NM where the legislature, governor and judicial system love criminals.

    I am sure we will hear more from this lowlife POS once he is out again in 2033 with a clean adult record like nothing ever happened.
