According to a criminal complaint at around 12:40 AM, while stationed at a DWI checkpoint, a New Mexico State Police (NMSP) Officer approached a blue Chevy pickup that had pulled up. Contact with the driver was initiated through the driver-side window, with identification and the purpose of the checkpoint clearly communicated. The female driver, avoiding eye contact, emitted a strong alcoholic odor.
The NMSP officer requested the defendant, BCSO Deputy Adrienne Marie Seay, meet him in front of his patrol unit for further testing. During this interaction, the NMSP officer observed bloodshot and watery eyes, along with the persistent scent of alcohol on the defendant’s breath and person. Seay also had slurred speech confirming impairment, and the defendant admitted to consuming wine before driving.
Seay did consent to Standardized Field Sobriety Tests (SFSTs), and she performed poorly, leading the officer to conclude the inability to operate a vehicle safely. Subsequently, Seay was arrested for driving under the influence of intoxicating substances. The New Mexico Implied Consent advisory was read, but the defendant after understanding this still declined a breath test by stating “No.”
The NMSP officer then went on to report that upon inspection, the defendant had no debris in her mouth and no access to anything consumable for over 20 minutes. The NMSP officer then transported Seay to the Albuquerque State Police Office where she refused to provide valid breath samples on an operational IR-8000 breathalyzer. All requisite paperwork was completed, and the defendant was transferred to the Prisoner Transportation Center without incident.
Deputy Seay had received a prestigious department award in May 2023 for Deputy of the Quarter.
Sheriff John Allen said in a statement:
“This morning, I was informed of the arrest of one of our deputies for driving while intoxicated. This incident deeply concerns me, as it does not align with the high standards and values of the Bernalillo County Sheriff’s Office. Our fundamental duty is to uphold the law and ensure public safety, and this deputy’s actions are a betrayal of that trust.
With New Mexico’s alarming statistics on DWI fatalities, it’s imperative for us as law enforcement officers to set an example in combating this entirely preventable crime. The deputy involved has been placed on administrative leave pending an internal investigation.
I offer my sincere apologies to our community for this incident. I also want to thank the New Mexico State Police for their professionalism in handling this matter. Their actions demonstrate the importance of holding all individuals accountable for their actions, irrespective of their position.
As we move forward, the Bernalillo County Sheriff’s Office reaffirms its dedication to turning the tide against DWI in our community and upholding the law without prejudice or favor.”
