Today, in a press conference held outside the Pete V. Domenici US Courthouse, the U.S. Attorney’s Office for New Mexico revealed a federal criminal complaint against Jaremy Smith, identified as the perpetrator in the assassination of New Mexico State Police (NMSP) Officer Justin Hare. Following Smith’s apprehension by the Bernalillo County Sheriff’s Office (BCSO), formal federal charges have been filed.

US Attorney Alexander M.M. Uballez stood alongside Raul Torrez, the Attorney General for the State of New Mexico, Sam Bregman, the Second Judicial District Attorney, Jason Bowie, the Secretary of the Department of Public Safety (DPS), as well as officers from the New Mexico State Police and deputies from the Bernalillo County Sheriff’s Office.
US Attorney Alexander M.M. Uballez thanked Secretary Bowie, the NMSP Chief Troy Weisler, BCSO Sheriff John Allen, the officers with the NMSP, deputies from the Quay County Sheriff’s Office, deputies from the Bernalillo County Sheriff’s Office, and all of the local law enforcement “who worked tirelessly in the face of despair.” Uballez also thanked the gas station attended “who was not a trained investigator or not an official or not a cop” who was “brave,” did the right thing, “standing up for someone she’d never met,” and called the police when she had a hunch.
DPS Secretary Jason Bowie also thanked a number of people for their support including US Attorney Alexander M.M. Uballez and Raul Bujanda, Special Agent in Charge of the FBI Albuquerque Field Office, who was not present at the press conference today. Secretary Bowie went on to say that while they were elated Smith was captured, it was short lived, because of the tragedy of losing two first responders, Crew Chief Sgt. Phonesia Machado-Fore and NMSP Officer Justin Hare. Secretary Bowie talked about “remaining focused for the prosecution” and ensuring all the evidence is processed and everything is ready for trial. Secretary Bowie talked about solidarity for Marion County during their time of loss and sending two NMSP officers to Crew Chief Sgt. Machado-Fore’s funeral.
Attorney General for the State of New Mexico Raul Torrez talked about how Officer Hare “represented the best of us and our community, he was doing what his community raised him to do,” trying to help someone and he was brutally ambushed. NM Attorney General Torrez said Officer Hare and his family deserves the best in terms of securing justice. Torrez said that state is holding off on or delaying charging Smith until the federal charges are complete. Federal charges carry more severe penalties compared to sentencing guidelines in New Mexico. Once the federal charges are complete, Torrez mentioned that the state will then proceed with charging Smith. Torrez asserted the state will also pursue this until the end and ensure that the family and communities in both Logan and Tucumcari know they will remain steadfast and pursue justice for Officer Hare until the end.
US Attorney Uballez stated the federal death penalty is authorized by the Attorney General of the United States Merrick Garland, it is the statute of carjacking resulting in death. The federal criminal complaint accuses Smith of carjacking resulting in death and the discharge of a firearm during and in relation to a violent crime. If found guilty of these charges, Smith could be sentenced to a mandatory minimum of 10 years in federal prison for the firearms offense. The more severe charge of carjacking resulting in death carries a maximum penalty of life imprisonment or capital punishment. There is no parole in the federal system. Smith was scheduled for an appearance in the courthouse today at noon.
US Attorney Uballez voiced that as of today, no one has been charged for harboring Smith. He also mentioned that the US Attorney in South Carolina has not pursued federal charges against Smith for the death of Crew Chief Sgt. Machado-Fore.
US Attorney Uballez disclosed that the weapon used for both murders was reportedly a 9mm handgun but he did not elaborate any further. US Attorney Uballez would not comment on why Smith was in New Mexico or where he was between February and March.
Crew Chief Sgt. Machado-Fore’s preliminary autopsy was conducted earlier this week in South Carolina. It was determined that she was shot in the head, and the manner of death is classified as a homicide, according to Dillon County Coroner Donnie Grimsley.
