Albuquerque – On August 9th, 2026, the Albuquerque Police Department received a call about an Door Dash driver in distress. The driver claimed she had been shot at while delivering to an apartment. The incident began at 1119 Mary Ellen ST NE when 31-year-old Nathan Burks ordered something then fired shots at the Door Dash driver who delivered.
According to the criminal complaint, the delivery driver was walking when Burks came out of the house and threatened her. He began to fire his gun in her direction. APD responded to the scene and they observed Burks with the firearm and another firearm in his waistband. He fired an additional shot in the air.
A SWAT activation was initiated due to the escalating violence by Burks. At one point, Burks called 911 and told the dispatcher police were the ones trying to shoot him and that is why he ran inside his residence.
After a tense SWAT standoff, Burks gave up peacefully and was taken into custody. He has a long felony criminal record dating back to 2013 with crimes related to drugs, stealing cars, and using guns.
Burks was booked into MDC where he is now charged with aggravated assault with a deadly weapon and negligent use of a deadly weapon.
