Deputy District Attorney Christine Jablonsky and Senior Trial Attorney Emilie Edmonds prosecuted the case. Gonzales now awaits sentencing.

Brian Keith Rascon
Case Number: D-202-CR-2023-02324
- Felony Sexual Offenses
On July 28, 2025, at 8:30 AM, a jury trial in the case of State of New Mexico v. Brian Keith Rascon will be held in Courtroom 620, presided over by Judge Brett R. Loveless.
UPDATE:
On the evening of Thursday, July 31, a jury convicted Brian Rascon of three counts of first-degree criminal sexual penetration with a firearm enhancement for his role in a brutal 1991 home invasion and assault.
Case Background:
In July 1991, Rascon and several masked, armed accomplices broke into a woman’s home in search of drugs and money. When they didn’t find any, Rascon and another man sexually assaulted the victim at the same time, inflicting severe psychological trauma. The group fled the scene, and the case went cold for decades.
Authorities tested the sexual assault kit in 2020 and matched DNA evidence to Rascon. Now 52, Rascon has 11 prior felony convictions and faces up to 57 years in prison.
The Sexual Assault Kit Initiative (SAKI) Unit, also known as the Cold Case Rape Team, helped solve the case. The unit has secured more than two dozen convictions in under three years.
Prosecutors Andrew McCants and Lisa Trabaudo led the successful prosecution.
Courts presume that the defendant is innocent unless and until the prosecution secures a conviction through due process.
