Judge Suspends Child Killer’s Prison Sentence, Violent Felon Walks Free Amongst Us

Democrat Judge Courtney Weaks used her discretion and authority to suspend teen killer Michael Flores’ 12-year prison sentence, allowing him to walk free.

We have been covering the murder of a child which happened last year involving Thomas Acee, an FBI agent’s son, and his accomplice, Michael Flores. The case stems from a downtown shooting into a car that left 13-year-old Michael Tubb dead and another teen wounded.

The Albuquerque Police Department investigated the case and found Acee and Flores were the responsible parties in the case. Flores made a plea deal with the District Attorney to testify against Acee to identify him as the shooter.

In October 2024, it came to light that Flores had been released with an ankle monitor, even though he was implicated in Tubb’s murder. For reasons unknown, Second Judicial District Court Judge Joseph Montano ruled that Flores did not pose a risk to the community despite Flores’ role in the killing of a 13-year-old.

This summer, Acee was found dead in his jail cell at the Metropolitan Detention Center and it sparked an investigation. It also made the plea deal a moot point since Acee’s case would no longer move forward.

Tubb’s family pushed for harsh prison time for Flores. It is unclear why Judge Weaks did not give any prison time for such a violent crime against two teens.

Weaks was elected to the bench in 2020 and in 2024 was retained by Bernalillo County voters. She is up for retention in 2031. Flores would have been half way through his prison sentence when Weaks would be campaigning to be retained.
