On Friday, February 14, 2025, the New Mexico State Police announced that they have placed an officer on leave amidst the FBI’s DWI enterprise investigation. The named NMSP officer is Sergeant Toby Lafave.

Sgt. Lafave has been a respected member of the New Mexico State Police Departments DWI unit. One of Lafave’s most recent high profile arrests involved an Albuquerque Police Officer who was caught speeding and smelled of alcohol. In June 2024, Lafave placed APD officer Jordan Hernandez under arrest for speeding and DWI.

Following the placement of their officer on leave in connection with the DWI Enterprise Investigation, NMSP Chief Troy Weisler has issued the following statement:

“As a result of the ongoing investigation into allegations of DWI-related racketeering, I have placed New Mexico State Police Sergeant Toby Lafave on administrative leave pending both the FBI’s inquiry and our own internal investigation,” said Chief Weisler of the New Mexico State Police.

“Let me be clear—any misconduct or criminal behavior within our ranks will not be tolerated. The New Mexico State Police holds its officers to the highest ethical and professional standards. If it is found Sergeant Lafave’s actions have violated the law or our policies, he will be dealt with swiftly and decisively. I also want to assure the public that our internal investigation is a top priority.

I will do everything in my power to ensure any State Police officer who engaged in corrupt behavior is prosecuted to the full extent of the law. We will not allow the actions of any individual to tarnish the reputation and sacrifice of the men and women in this department who uphold their oath with pride and honor every day.”

As of this publication, 13 officers from the Albuquerque Police Department have either been placed on leave, retired before being named, or resigned. One deputy from the Bernalillo County Sheriff’s Department and one officer from the New Mexico State Police have been identified.

Lafave has now been added to the growing Bernalillo County District Attorney Giglio list. 2nd District Attorney Spokeswoman Nancy Laflin confirmed they are now reviewing all of his cases. Most likely, several of Lafave’s cases will now be dismissed as a result of this investigation.

  1. NMSP wasn’t liked by the APD DWI team when I knew him. They didn’t cross paths often and I know him. This appears to be a witch hunt to save Montano, Alba and Mendez from doing long prison terms. It’s obviously politically motivated too!

    1. None of these police agencies are blameless-they’ve all had a hand in this. It’s ironic how state police are put on a pedestal despite their corruption. KRQE asked Pete Kassetas how he felt about one of his own (Toby Lafave) being part of this corruption, yet NM tax payers paid out millions of dollars for sexual harassment crimes committed by MR. KASSETAS and he was still able to retire with full pension. Let’s not forget another state police officer who tried running over a man his ex was dating and still walked away with full pension and his nose full of coke! All of this was swept under the rug to make state police look better then other agencies.

  2. There’s a whole other level of corruption if the FBI would dig a little deeper. In 2010 Vine Peele, CCP Director, was charged with receiving bribes for selectively allowing BCDC inmates to be released on house arrest. Tom Clear had a working relationship with Vince. Somebody should revisit this aspect of the Tom Clear Enterprise. Ain’t sayin…

        1. By all means, be your own hero. Run around wearing a cape if it pleases you. Nobody really cares. But the rest of us will be glad the police are around when your drug-addicted menace offspring that you’re undoubtedly indoctrinating with your “FUCK THE POLICE” mindset carjack us and we want to get our property back.

  3. Anyone recall who was the DWI Sgt in 1995 and earlier?
    Anyone recall when APD got so involved in the promotional process when it was left up to a single lady.
    Anyone interested in filing an IPRA on the promotional process begininnig say, 1990 and who requests changes.
    Anyone who can put a time line together, beginning in, say 1990 on the promotional process, name who made the list, etc. We all know top of the list were current/former DWI Officers, very interesting whose name will shine through as the top dog, until——–
