On Sunday, April 20, the Albuquerque Police Department announced that APD homicide detectives had charged Deomtray Davis, 27, in connection with the April 4, 2025, shooting that led to the death of a bystander.

Davis was among a group of homeless individuals when a fight broke out near Indiana St SE, just south of Central Avenue SE. Davis knew one of the two men involved in the altercation. During the fight, one of the individuals falsely claimed that Jonathan Bouldin had stabbed him, though no stabbing occurred.

As Davis sat on a nearby curb, he allegedly opened fire on Bouldin around 3:05 PM. The bullet struck Bouldin in the right forearm near his elbow, exited, and hit a bystander who was standing several feet behind him.

The second victim, later identified as 39-year-old Brian Miller, suffered a fatal gunshot wound to the head and died at the scene. At the time of the incident, Bouldin was located by responding officers and medical personnel at the ART – International District Station at Central Ave and Louisiana Blvd. Albuquerque Ambulance transported him to a local area hospital.

Surveillance footage captured Davis walking away from the area on foot. Detectives later found a firearm that Davis had discarded in a trash can located in a nearby parking lot.

Police arrested Davis on April 9, 2025, on unrelated charges. APD homicide detectives interviewed him and subsequently obtained a DNA warrant. On Saturday, April 19, they re-booked him on new charges, including an open count of murder and tampering with evidence.
