Frank Joseph Porras

Judge Clara Moran will preside over the jury trial in State of New Mexico v. Frank Joseph Porras, which will begin at 8:30 AM on May 11, 2026 in Courtroom 416 and continue daily at 8:30 AM from May 12 through May 15, 2026 in Courtroom 402.

Homicide Trial Begins in 2021 Gas Station Shooting

The Albuquerque Police Department investigated the January 20, 2021 shooting death of Matthew Werth at the Quick Track gas station on 12524 Central Ave SE. Surveillance video showed an unidentified man spending time around two nearby gas stations, briefly entering an unattended vehicle, and then approaching Werth before shooting him in the chest without clear provocation. The suspect fled on foot, and Werth later died from his injuries. A 9mm casing and bullet were recovered at the scene, and forensic analysis confirmed the fatal wound.

The investigation later identified Frank Porras as a suspect after a ballistic match was made through the Long Beach Police Department’s firearms database linking a gun found in his possession to the Albuquerque homicide. Evidence showed Porras traveled from Albuquerque to California shortly after the killing using an Amtrak ticket purchased the next day. In California, he was arrested for a series of violent crimes, including attempted murder of a gas station cashier and robbery, and was found with a handgun consistent with that of the murder weapon.

Witness statements from acquaintances indicated Porras had admitted being involved in a shooting in New Mexico and described using a firearm in a confrontation. The criminal complaint states Porras called a friend from jail in and stated “he was going to have “a needle in his arm” for what he had done the previous week, likely referring to his shooting of the gas station cashier (California), and the “one in New Mexico.””

Investigators also noted behavior suggesting he had been “casing” the area before the shooting and that he lived in close proximity to the crime scene at the time. During a custodial interview, Porras described heavy methamphetamine use, paranoia, and criminal activity to support his drug use, and reacted emotionally when confronted about the homicide.

Additional interviews and evidence, including surveillance analysis and travel records, were used to build a timeline linking Porras to the scene and subsequent events. Based on the combined forensic, video, witness, and behavioral evidence, investigators concluded there was probable cause to believe Porras shot and killed Matthew Werth during an attempted robbery.

Editor’s note: Prior to publication, we noticed that this case appeared to have been dismissed. We reached out to the Second Judicial District Attorney’s Office for more information, and officials stated that the case was dismissed without prejudice, but they plan to refile the charges as soon as possible.


Courts presume that the defendant is innocent unless and until the prosecution secures a conviction through due process. This means the defendant remains legally not guilty unless the prosecution proves the charge beyond a reasonable doubt and a jury returns a verdict of guilty.
