Albuquerque –
On June 29, 2024, the Albuquerque Police Department was called to a domestic altercation at an apartment located in the 760 block of Juan Tabo Blvd. NE. The calling party’s daughter was involved in the altercation with Andre Miller, a 28-year-old resident of Albuquerque. According to the criminal complaint, an argument ensued about how his child’s mother’s name was labeled in his cell phone which began the original altercation in the home.
As stated in the criminal complaint, a dog from the residence got out of the apartment unit and ran into busy Juan Tabo traffic. The dog was hit by a car on Juan Tabo and died on scene.
It should be noted that City of Albuquerque Animal Welfare Department officers were not on call at the time, and there was concern the dead dog would just be left on the side of the road all weekend. APD dispatchers and officers made urgent calls to the Animal Welfare Department to finally get an Animal Control Officer to the scene to remove the deceased dog.
When APD officers arrived on scene, Miller decided to fight officers to try to avoid arrest. Officers were able to wrestle him to the ground and while doing so, Miller bit an officer’s leg like a dog.
During the investigation, an additional victim came forward to say Miller assaulted and battered him also. The second victim was trying to help the daughter with the deceased dog when Miller became violent with him.
Miller was charged with violation of probation, aggravated battery on peace officer, battery on a household member, and assault on a non-household member.
